2011 H-1B Cap Reached

January 28, 2011—The United States Fiscal Year 2011 H-1B cap has been reached as of January 26, 2011. U.S. Citizenship and Immigration Services (USCIS) will not accept any further standard or advanced degree H-1B cap-subject cases for FY 2011.

H-1B cap-subject petitions that were received on January 26, 2011 will be entered into a computer lottery and selected cases will be processed to completion. All other cases will be rejected and returned. Any cap-subject case received after January 26 will be rejected and returned until the FY 2012 H-1B cap season starts on April 1. USCIS has clarified that a properly filed case will be considered received when USCIS receives the petition, not by the date it is postmarked.
